1. Promoter

1.1 The promoter of this competition is HOBBY WATCH SA (PTY) LTD (“the Promoter”).

1.2 Registration number: 2026/356223/07.

1.4 Competition contact email: contact@seagull1963.com.

1.5 The competition is promoted through the Seagull1963.com website, the @Seagull1963 Instagram account and the Seagull1963.com Facebook page.

2. Acceptance of these rules

2.1 By entering, an entrant confirms that they have read, understood and agreed to these Terms and Conditions.

2.2 No term displayed in a social-media post overrides these Terms and Conditions.

2.3 If any promotional post contains an obvious error or conflicts with these Terms and Conditions, the Promoter will correct it as soon as reasonably possible without unfairly prejudicing existing entrants.

3. Competition period

3.1 The competition opens on Tuesday, 8 September 2026 at 17:00 South African Standard Time (“SAST,” UTC+2).

3.2 The early-entry period ends 72 hours after publication of the giveaway post at the opening time stated above, on Friday, 11 September 2026 at 17:00 SAST.

3.3 The early-entry winner is expected to be announced on Saturday, 12 September 2026 at 15:00 SAST.

3.4 The main competition closes on Tuesday, 22 September 2026 at 17:00 SAST.

3.5 The main winner is expected to be announced on Wednesday, 23 September 2026 at 15:00 SAST.

3.6 An entry is received only when all required entry steps have been completed before the relevant deadline.

3.7 The Promoter is not responsible for entries delayed or prevented by internet, platform, account or messaging failures outside its reasonable control.

4. Eligibility

4.1 Entrants must be natural persons aged 18 or older.

4.2 An entrant must own or have received a genuine Legacy Burgundy Edition originally purchased from Seagull1963.com.

4.3 A person who received the watch as a genuine personal gift may enter, provided the watch was originally purchased from Seagull1963.com and the entrant can provide reasonable proof of eligibility.

4.4 Watches supplied free of charge by the Promoter, Seagull1963.com or a related company for influencer, review, promotional, press, affiliate or ambassador purposes do not qualify.

4.5 Directors, members, partners, employees, agents or consultants of the Promoter or a related company may not enter or win.

4.6 Suppliers of goods or services connected with the administration or marketing of this competition may not enter or win.

4.7 The spouses, life partners, business partners and immediate family members of the persons described in clauses 4.5 and 4.6 may not enter or win.

4.8 The competition is open only to residents of countries to which Seagull1963.com can lawfully and practically deliver the prize.

4.9 Residents of Hong Kong are excluded unless the Promoter confirms otherwise following appropriate legal and licensing advice.

4.10 The competition is not available in Pakistan, Bangladesh, Türkiye, Iraq, Iran, Egypt or any other country to which Seagull1963.com does not currently ship.

4.11 South African residents are eligible.

4.12 Residents of all other African countries are excluded.

5. How to enter on Instagram

5.1 To enter through Instagram, an entrant must:

  1. Follow @Seagull1963 on Instagram;
  2. Like the main Instagram giveaway post;
  3. Post an original photograph of their Legacy Burgundy Edition to their Instagram feed or Story;
  4. Tag @Seagull1963 in the post or Story;
  5. Include #MyBurgundy1963; and
  6. Send the photograph to @Seagull1963 by direct message.

5.2 Private-account and Story entries are permitted, but the photograph must be sent by direct message before the deadline.

6. How to enter on Facebook

6.1 To enter through Facebook, an entrant must:

  1. Follow the official Seagull1963.com Facebook page;
  2. Like the main Facebook giveaway post;
  3. Post an original photograph of their Legacy Burgundy Edition to their Facebook feed or Story;
  4. Tag the official Seagull1963.com Facebook page;
  5. Include #MyBurgundy1963; and
  6. Send the photograph to the Seagull1963.com page through Messenger.

6.2 Private-account and Story entries are permitted, but the photograph must be sent through Messenger before the deadline.

7. Entry requirements and limits

7.1 Only photographs are accepted. Videos and other content formats do not constitute valid entries.

7.2 Each distinct qualifying photograph counts as one entry.

7.3 Each person may submit a maximum of five distinct photographs across Instagram and Facebook combined.

7.4 Posting or sending the same photograph through both platforms does not create an additional entry.

7.5 Cropping, filtering, recolouring or otherwise editing the same underlying photograph does not make it a distinct photograph.

7.6 An entrant may include themselves in the photograph, but this is not required.

7.7 Professional photography or equipment is not required.

7.8 No fee is charged to enter, other than an entrant’s ordinary internet or data costs.

8. Original content and third-party rights

8.1 Each entrant confirms that:

  1. They took the photograph or hold all rights required to submit it;
  2. The photograph does not infringe another person’s copyright, privacy, publicity or other rights;
  3. They have obtained permission from every identifiable person appearing in the photograph; and
  4. Submission and permitted use of the photograph will not breach any agreement with another person.

8.2 The Promoter may request evidence supporting these confirmations.

9. Early-entry prize

9.1 One valid entry completed during the first 72 hours will be selected randomly.

9.2 The early-entry winner will receive one in-stock watch strap of their choice from the straps listed for sale on Seagull1963.com at the time the prize is selected.

9.3 The early-entry winner remains eligible for the main draw.

9.4 The early-entry winner may therefore win both the strap and one main-draw prize.

10. Main prize

10.1 The main prize is one Bronze Edition 1963 Seagull Movement | Lume | 38mm, valued at €479 at the commencement of the competition.

10.2 One valid entry will be selected randomly to receive the main prize.

10.3 The Promoter will arrange and pay for standard prize delivery to the winner’s eligible address. Import duties, import taxes, customs-clearance charges and any reimbursement will be handled under clause 15.

11. Additional prizes and winners

11.1 The Promoter may add further prizes or additional winners before the main closing date.

11.2 An additional prize will not replace, reduce or adversely affect any prize already offered.

11.3 All valid main-draw entries will automatically be eligible for any additional prize unless the additional prize is expressly offered to a broader group of existing entrants.

11.4 Additional winners will be selected using the same independently overseen random-draw procedure.

11.5 If second- or third-place prizes are added, winners will be drawn sequentially and removed from the remaining main-draw pool after selection.

11.6 A person may win no more than one main-draw prize. The separate early-entry prize does not count as a main-draw prize.

11.7 Any additional prizes, their values and the number of additional winners will be announced before the main competition closes.

12. Random selection and oversight

12.1 Winners will be selected through a random draw from all valid entries in the relevant pool.

12.2 Each valid photograph will be allocated one unique anonymous entry ID in the draw, subject to the five-entry maximum. The mapping between entry IDs and entrants will be held privately by the Promoter.

12.3 The draw will use the free Wheel of Names random picker at https://wheelofnames.com/.

12.4 The conduct of the competition and selection of winners will be overseen and certified by an independent accountant, registered auditor, attorney or advocate.

12.5 For each draw, every verified entry ID in the relevant pool will be entered once into Wheel of Names with equal weighting. The wheel will be spun once under independent oversight, and the entry ID selected by the wheel will be the provisional winner. The input list, wheel settings, result and a recording of the draw will be retained. Any additional-prize draw or redraw will follow the same process, subject to these rules. Where an entrant must be removed from a subsequent draw under these rules, all entry IDs belonging to that entrant will be removed from the relevant pool. The early-entry winner remains eligible for the main draw.

12.6 The Promoter will retain the entry list, draw records, winner verification, prize-delivery evidence and required certification for the legally required period.

13. Winner notification and response

13.1 A provisional winner will be contacted through the account used to submit the entry and, where available, by email.

13.2 The Promoter may publicly announce the winner’s name, social-media username or both through its Instagram and Facebook channels, subject to applicable privacy requirements.

13.3 A provisional winner must respond within 72 hours of the first direct notification.

13.4 A provisional winner must provide the reasonable information required to verify:

  1. Their identity and age;
  2. Their country and delivery address;
  3. Their ownership or receipt of a qualifying Legacy Burgundy Edition;
  4. The original purchase of that watch from Seagull1963.com; and
  5. Their compliance with these Terms and Conditions.

13.5 Verification may include an order number, watch serial or edition number, proof of delivery, original photograph file, identity document or other reasonable evidence.

13.6 If a provisional winner does not respond within the required period, cannot be verified, is ineligible, declines the prize or is disqualified, the Promoter may perform another independently overseen random draw.

13.7 A person is not a confirmed winner until verification has been completed.

14. Right to reject or disqualify entries

14.1 The Promoter may reject or disqualify an entry where it reasonably determines that the entry:

  1. Was submitted late, is incomplete or does not follow the entry instructions;
  2. Exceeds the maximum number of permitted entries;
  3. Duplicates another photograph submitted by the same entrant;
  4. Does not clearly show a Legacy Burgundy Edition;
  5. Is not the entrant’s original work or infringes another person’s rights;
  6. Contains unlawful, offensive, discriminatory, unsafe or inappropriate material;
  7. Was generated, submitted or manipulated fraudulently;
  8. Was submitted using automated methods, false accounts or misleading information;
  9. Cannot be linked to an eligible entrant or qualifying watch;
  10. Breaches these Terms and Conditions or the applicable platform’s terms; or
  11. Would make the Promoter’s acceptance or use of the entry unlawful.

14.2 The Promoter may also reject an entry for another materially similar and objectively reasonable ground necessary to protect the integrity, legality or fair administration of the competition.

14.3 The Promoter will exercise these rights reasonably and in good faith.

14.4 Disqualification of one photograph does not automatically disqualify the entrant’s other valid photographs unless the breach affects the entrant’s overall eligibility or the integrity of their participation.

15. Prize conditions

15.1 The Promoter does not charge a fee to claim a prize and will arrange and pay for standard delivery. Import charges requested by customs authorities or the appointed courier will be handled as set out below.

15.2 Customs authorities or the appointed courier may require the recipient to settle import duties, import taxes or clearance charges locally before releasing the shipment. Before making payment, the winner must send the itemised assessment or invoice and any payment deadline to contact@seagull1963.com so that the Promoter can verify the request and confirm arrangements in writing. The Promoter will respond promptly, taking account of the stated deadline.

15.3 The Promoter will cover reasonable, necessary and documented import duties, import taxes and standard customs-clearance charges associated with delivery of the prize. Reasonableness will be assessed objectively by reference to the correct customs valuation, classification and applicable rates, together with customary clearance charges. A charge is not unreasonable merely because it is high.

15.4 Where lawful and voluntarily agreed with the winner in writing, the winner may pay approved import charges directly to the customs authority or appointed courier and claim reimbursement from the Promoter. The Promoter will reimburse the approved amount actually paid, together with any necessary payment or currency-conversion fees agreed in advance, within 14 calendar days after receiving the official assessment, proof of payment and sufficient reimbursement details. A winner will not be required to advance personal funds as a condition of receiving the prize; if reimbursement is not lawful or the winner does not agree to advance payment, the Promoter will arrange direct payment, advance funding or another lawful delivery arrangement at its expense.

15.5 If a charge appears incorrect, excessive or disproportionate to a reasonable alternative delivery arrangement, the winner must contact the Promoter before paying it. The Promoter may seek a corrected assessment, dispute the charge, arrange lawful return or redirection of the shipment, or send a replacement of the same advertised prize model and specification, where this offers a lawful and more economical solution. The Promoter will coordinate the arrangements promptly with the winner and meet the costs of the alternative it selects. A replacement shipment does not, by itself, cancel charges already lawfully incurred; customs declarations must remain accurate.

15.6 To the extent permitted by law, the Promoter is not obliged to reimburse optional upgrades, duplicate charges, penalties, avoidable storage fees or other unnecessary expenses incurred without its prior written approval, including costs caused by an unreasonable failure to follow timely, lawful delivery instructions. Approval will not be unreasonably withheld or delayed. This limitation does not exclude necessary charges that could not reasonably have been approved in advance, costs caused by the Promoter or its appointed providers, amounts the Promoter is legally required to bear, or any reimbursement already approved in writing.

15.7 Prizes may not be exchanged for cash.

15.8 Prizes are not transferable to another person.

15.9 The Promoter will not substitute an advertised prize with a different prize. Sending another unit of the same advertised model and specification to resolve a delivery problem is permitted under clause 15.5.

15.10 A winner must provide a complete and accurate delivery address in an eligible country.

15.11 To the extent permitted by law, the Promoter is not responsible for delivery delays caused by customs authorities, local couriers or circumstances outside its reasonable control. It remains responsible for arranging delivery and resolving the delivery issue within a reasonable time, subject to applicable law.

15.12 The Promoter will never ask a winner to pay a prize-release fee to the Promoter or to provide a card PIN, password or one-time security code. Any genuine customs-payment request should be verified with the Promoter before payment. The Promoter may request the limited payment-account details reasonably necessary to make an agreed reimbursement.

15.13 Nothing in this clause permits the Promoter to withhold or cancel an awarded prize solely because delivery or import charges are higher than expected, to leave the winner with costs the Promoter is legally required to bear, or to restrict any right or liability that cannot lawfully be restricted. These arrangements remain subject to clause 20.

16. Use of submitted photographs

16.1 Submitted photographs may be reused for the organic purposes specified in clause 16.2, subject to the limitations below.

16.2 By entering, an entrant grants the Promoter and Seagull1963.com a non-exclusive, worldwide, royalty-free licence to reproduce and repost the submitted photograph through their owned organic social-media accounts, website and email communications, with credit where reasonably practicable.

16.3 Ownership of the photograph remains with the entrant.

16.4 Entry does not grant permission to use the photograph in paid advertising.

16.5 Paid-advertising usage will require separate written permission from the entrant.

16.6 No winner or entrant is required to appear in further marketing, provide an endorsement or participate in publicity as a condition of entering or receiving a prize.

16.7 Where an entrant or another person is identifiable in a photograph, the Promoter will respect any rights that cannot lawfully be waived and any applicable right to decline further marketing use.

17. Personal information

17.1 Personal information will be collected and used to administer the competition, verify eligibility, contact winners, arrange prize delivery, prevent fraud and comply with legal recordkeeping requirements.

17.2 Information may be processed by the Promoter, Seagull1963.com and service providers reasonably required to administer the competition.

17.3 HOBBY WATCH SA (PTY) LTD is the responsible party for entrants’ personal information. The Promoter handles entry messages, maintains the entry register, verifies purchases and eligibility, handles winners’ delivery details, arranges prize delivery, and manages the storage of and access to competition records.

17.5 Personal information may be transferred between countries where reasonably necessary to administer the competition, subject to applicable data-protection requirements.

17.6 Competition records will be retained for the period required by applicable law and thereafter deleted or anonymised unless a longer period is lawfully required.

17.7 Personal information will not be added to an unrelated marketing list without the appropriate consent.

18. Suspension, cancellation and technical problems

18.1 The Promoter may temporarily suspend or, where continuation becomes unlawful or reasonably impossible, cancel the competition because of fraud, platform failure, security incidents, legal requirements or circumstances outside its reasonable control.

18.2 The Promoter will not cancel or suspend the competition merely to avoid awarding a prize.

18.3 Any suspension or cancellation will be announced through the same channels used to promote the competition.

18.4 Where reasonably and legally possible, the Promoter will preserve valid entries already received and award the prizes fairly.

19. Instagram and Facebook

19.1 This competition is not sponsored, endorsed or administered by, or associated with, Instagram or Facebook.

19.2 By entering, each entrant releases Instagram and Facebook from responsibility or liability arising from or relating to this competition, to the extent permitted by law.

19.3 Entrants provide their information to the Promoter and not to Instagram or Facebook.

19.4 Entrants must comply with the applicable platform’s terms and community standards.

19.5 Entrants are not required to share the main giveaway post to their personal timeline or tag friends to enter.

20. Liability

20.1 Nothing in these Terms and Conditions excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

20.2 To the extent permitted by law, the Promoter is not responsible for loss caused by:

  1. An entrant’s failure to comply with these Terms and Conditions;
  2. Incorrect information supplied by an entrant;
  3. Platform, network or communication failures outside the Promoter’s reasonable control; or
  4. Unauthorised third parties falsely claiming to represent the Promoter.

20.3 Nothing in these Terms and Conditions releases the Promoter from responsibility for fraud, gross negligence, wilful misconduct or any other liability that cannot lawfully be excluded.

21. Changes and interpretation

21.1 The Promoter may make non-material corrections or clarifications to these Terms and Conditions where they do not unfairly prejudice entrants.

21.2 Material changes will be announced through the same channels used to promote the competition.

21.3 No change will retrospectively invalidate a valid entry or reduce a vested right.

21.4 The Promoter’s reasonable determination regarding administration or entry validity will apply, subject to applicable law and an entrant’s statutory rights.

21.5 If any provision is invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

22. Governing law

22.1 These Terms and Conditions are governed by South African law.

22.2 Disputes may be brought before South African courts with jurisdiction, without limiting any right an entrant has under applicable law to approach a consumer-protection body, regulator, tribunal or other competent forum.

22.3 The choice of governing law does not exclude any mandatory consumer-protection or other rights that apply to an entrant and cannot lawfully be excluded.
